Terms & Conditions (USA)
1. About These Terms
These Terms and Conditions (“Terms”) govern your access to and use of the United States WATERROWER | NOHRD website, including purchases made through the website.
The website is operated by WaterRower (US) Inc. (“WaterRower,” “we,” “us,” or “our”), located at 560 Metacom Avenue, Warren, Rhode Island 02885.
By accessing the website, creating an account, or placing an order, you agree to these Terms. If you do not agree, you should not use the website.
Our Privacy Policy, Shipping Policy, Return Policy and applicable product warranties form part of these Terms. Additional terms may apply to promotions, financing, applications, subscriptions or other services.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to place an order through the website.
If you use the website on behalf of a business or other organization, you confirm that you have authority to bind that organization to these Terms.
3. Website Accounts
You may be required to create an account to access certain website features.
You are responsible for:
- Providing accurate and current information.
- Maintaining the confidentiality of your login details.
- Restricting access to your account and devices.
- All activity conducted through your account.
Please contact us promptly if you believe your account has been accessed without authorization.
We may suspend or close an account where we reasonably believe it is being used fraudulently, unlawfully or in violation of these Terms.
4. Permitted Use
You may use the website only for lawful personal or business purposes.
You must not:
- Use the website in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the website, accounts, servers or systems.
- Introduce viruses, malicious code or other harmful technology.
- Interfere with the operation or security of the website.
- Use automated systems to scrape, extract or reproduce website content without our written permission.
- Use our content, trademarks or products in a misleading, fraudulent or unauthorized manner.
- Impersonate another person or provide false information.
We may restrict or terminate access where these requirements are not followed.
5. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, dimensions, images, availability and pricing are accurate. However, errors may occasionally occur.
Product images are provided for illustration. Screen settings, lighting and photography may affect how colors and finishes appear.
Natural materials such as wood may vary in color, tone, grain and texture. These natural variations are part of the character of the material and are not normally considered defects.
We may update product specifications, designs or packaging where this does not materially reduce the product’s function or quality.
6. Prices, Taxes and Payment
Unless otherwise stated, prices shown on the US website are in US dollars.
Applicable sales tax, shipping charges and other order-specific costs will be calculated and displayed during checkout.
We accept the payment methods displayed at checkout. By submitting payment information, you confirm that you are authorized to use the selected payment method and authorize us and our payment providers to process the transaction.
Financing and installment payment services are provided by third parties and are subject to their own eligibility requirements, credit decisions and terms.
If a product is listed at an incorrect price because of a typographical, technical or other error, we may cancel the affected order and issue a refund for any amount paid.
7. Orders and Acceptance
Submitting an order constitutes an offer to purchase the products in your cart.
An order confirmation email acknowledges that we have received your order. It does not necessarily mean that the order has been accepted.
Your order is accepted when we confirm shipment or otherwise expressly confirm acceptance.
We may decline or cancel an order where:
- A product is unavailable.
- Payment cannot be authorized.
- Pricing or product information is incorrect.
- We suspect fraud or unauthorized activity.
- Delivery restrictions prevent us from fulfilling the order.
- The order violates these Terms or another applicable policy.
If we cancel an order after payment has been taken, we will refund the amount paid for the canceled items.
Separate quotations or written agreements may apply to commercial, hospitality, dealer, distributor or other business purchases. Where there is a conflict, the separately signed agreement will take precedence.
8. Shipping and Delivery
Products are shipped only to destinations available through the applicable checkout.
Shipping and fulfillment estimates are provided in our Shipping Policy or during checkout. These are estimates rather than guaranteed delivery dates unless we expressly agree otherwise in writing.
Orders may be delivered in more than one shipment.
Products requiring freight delivery are generally delivered using the service described during checkout or in our Shipping Policy. Unless an additional service has been purchased, freight delivery may be limited to curbside delivery with liftgate service.
You are responsible for:
- Providing a complete and accurate delivery address.
- Ensuring suitable access for the delivery.
- Being available for any scheduled delivery.
- Paying additional carrier charges caused by an incorrect address, missed appointment, storage request, delivery reassignment or other circumstance within your control.
You should inspect packages when delivered. Visible freight damage should be recorded with the carrier and reported to WaterRower as soon as possible, preferably within 24 hours, together with photographs and order details. Failure to report within this period does not remove any rights that cannot legally be limited.
Risk of loss passes to you when the order is delivered to you or your authorized recipient, except where applicable law provides otherwise.
9. Cancellations, Returns and Refunds
If you wish to cancel an order, contact us as soon as possible. We cannot guarantee cancellation once processing or shipment has begun.
Returns are governed by our Return Policy in effect when the order is placed. You must contact WaterRower and obtain return authorization before sending a product back.
Returned products must be packaged appropriately and sent using the method specified in the return authorization. Unauthorized returns may be refused.
Depending on the reason for the return and the condition of the product, you may be responsible for original shipping charges, return shipping charges and any applicable restocking fee described in the Return Policy.
Refunds are calculated after the returned product has been received and inspected. Refund processing times may vary depending on the payment provider.
Defective products and warranty claims are handled under the applicable product warranty.
Nothing in these Terms limits any return, refund or cancellation right that cannot legally be excluded.
10. Product Warranties
WaterRower and NOHRD products are covered by the written limited warranty applicable to the relevant product.
Warranty periods, registration requirements, exclusions and claim procedures are set out in our Warranty Policy and accompanying product documentation.
Where registration extends a warranty period, you are responsible for completing the registration within the stated time.
The applicable written warranty is in addition to any rights that cannot be excluded under federal or state law.
11. Product Use and Safety
Fitness equipment must be assembled, maintained and used in accordance with the supplied instructions, safety warnings and intended use.
Before use, you should ensure that:
- The product has been assembled correctly.
- All fasteners and components are secure.
- The product is positioned on a stable and suitable surface.
- The surrounding area provides adequate clearance.
- Children and pets are appropriately supervised.

Stop exercising and seek appropriate medical assistance if you experience pain, dizziness, breathing difficulties or other concerning symptoms.
12. Intellectual Property
The website and its content—including text, images, videos, product designs, graphics, software, trademarks, logos and trade dress—are owned by or licensed to WaterRower and are protected by applicable intellectual property laws.

You may view and use website content for personal, non-commercial purposes. You may not reproduce, modify, distribute, publish, sell, license or commercially exploit website content without prior written authorization.
13. Reviews and Submissions
If you submit a review, photograph, comment, suggestion or other content, you confirm that:
- You own or have permission to submit it.
- It is accurate and reflects your genuine experience.
- It does not infringe another person’s rights.
- It is not unlawful, abusive, misleading or defamatory.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish and display the submitted content in connection with our business and marketing.
We may remove submitted content that violates these Terms or applicable law.
14. Privacy and Cookies
Our collection and use of personal information is governed by our Privacy Policy.
Our use of cookies and similar technologies is described in the Privacy Policy and any cookie settings or notices displayed on the website.
These Terms should not be interpreted as replacing or limiting the Privacy Policy.
15. Third-Party Services and Links
The website may contain links to or integrations with third-party services, including payment providers, financing providers, fitness applications and social media platforms.
Third-party services are governed by their own terms and privacy policies. We are not responsible for the content, availability or practices of third-party services that we do not control.
A link to a third-party website does not necessarily constitute an endorsement.
16. Website Availability and Disclaimer
We aim to keep the website accurate, secure and available, but we do not guarantee that access will be uninterrupted, error-free or free from harmful components.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
This disclaimer applies to the website and its informational content. Product warranty rights are governed by the applicable written limited warranty and applicable law.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WATERROWER AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR PRODUCTS.
Where liability cannot be excluded entirely, our total liability will not exceed the amount you paid for the product or service giving rise to the claim.
These limitations do not apply to liability arising from fraud, willful misconduct, gross negligence, death or personal injury where such liability cannot be excluded, or any other right or remedy that cannot legally be limited.
Some states do not allow certain warranty exclusions or limitations of liability. In those states, these provisions apply only to the maximum extent permitted by law.
18. Force Majeure
We will not be responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, terrorism, civil disturbance, government action, labor disputes, transportation disruption, supply-chain interruption, utility failure or communications failure.
We will take reasonable steps to reduce the effect of such an event and resume performance when reasonably possible.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles.
Except where applicable law provides otherwise, disputes relating to these Terms, the website or an order will be subject to the jurisdiction of the state or federal courts located in Rhode Island.
Nothing in this section prevents either party from bringing an eligible claim in small claims court or exercising rights that cannot legally be waived.
20. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on the website with an updated effective date.
Changes will apply from the date they are posted. Changes will not materially alter an order we have already accepted unless required by law or agreed with you.
Your continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms.
21. General Provisions
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations as part of a merger, reorganization, sale of business or transfer to an affiliated company.
These Terms, together with the policies and agreements referenced within them, constitute the agreement between you and WaterRower concerning use of the website and online purchases.
